Across the United States, drug usage is now tolerated at varying levels. Subsequently, drug testing laws are also different, with only 5 states deeming testing in the workplace to be legal. Although over 500 new bills were introduced in 2024 related to drug testing, the landscape of employment drug testing is in need of change.
Following the legalization of marijuana both recreationally and medically in many states, the rate of positive marijuana tests has skyrocketed. In the past 5 years alone, experts have observed a 45.2% increase. This boom could have serious implications for safety-sensitive industries. In fact, recreational marijuana laws are associated with a 10% increase in workplace injuries among young working professionals.
In order to mitigate the risk for vulnerable populations, states and leaders are cracking down harder on test tampering and are implementing drug testing measures for employees. States like Nebraska, Pennsylvania, and Virginia are already implementing these anti-cheating policies to discourage foul play during the testing process. Additionally, high-risk industries like energy, transportation, and construction have consistently been testing their workforce. These new policies will ensure safe and sober workplaces, preparing our most vulnerable workers and protecting the employees who need it the most.
